PROMOTION DESCRIPTION: Tricks for Treats Halloween Promotion (“Promotion”) begins at 12:00 AM Eastern Time (“ET”) on 10/19/2020 and ends at 11:59 PM ET on 10/30/2020 (“Promotion Period”).

SPONSOR: TDBBS LLC (Best Bully Sticks) 5701 Eastport Blvd Richmond, VA 23231

1. ELIGIBILITY: The Promotion is open only to individuals who are 18 years of age or older in the United States of America at the time of entry (“Entrant”). Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of Best Bully Sticks, and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies and companies involved in the design, implementation and execution of the Promotion (collectively, the “Promotion Entities”) are not eligible. NO PURCHASE IS NECESSARY TO ENTER THE CONTEST. The Promotion is void where prohibited by law.
   
   
   
2. AGREEMENT TO THE OFFICIAL RULES:By participating in the Promotion, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Promotion. Winning the prize is contingent upon fulfilling all requirements set forth herein.
   
   
   
3. ENTRY PERIODS:The Promotion begins on 10/19/2020 at 12:00 AM ET and ends on 10/30/2020 at 11:59 PM ET (“Entry Period”). Entries must be submitted within the valid end date/time in order to be eligible for entry.
   
   
   
4. HOW TO ENTER:During the Entry Period, beginning 10/19/2020 at 12:00 AM ET, entrant must:

• Like the specified Promotion post on @bestbullysticks Instagram page
• Tag 2 friends on the specified Promotion post on @bestbullysticks Instagram page
• Follow @bestbullysticks on Instagram
• Post a photo, video, or Instagram Story on your Instagram using #BBSTricksforTreats and tagging @bestbullysticks. Must be within the valid time frame.
• Have a public Instagram profile during the valid Entry Period.

ENTRIES MUST BE SUBMITTED BY 11:59 PM ET on 10/30/2020.

5. LIMIT: ONE (1) ENTRY PER PERSON OR EMAIL ADDRESS, REGARDLESS OF THE METHOD OF ENTRY.In the event more than one (1) Entry for the Promotion Period is received from any one person, the first Entry processed will be considered the only valid Entry received. In the event of a dispute, Entries will be deemed made by the authorized account holder of the Instagram profile submitted at the time of Entry. The authorized account holder is the natural person who is assigned to the Instagram profile. The potential winner may be required to show proof of being the authorized account holder. Use of any automated system to participate is prohibited and will result in disqualification.
   
   
   
6. ONE (1) GRAND PRIZE/APPROXIMATE RETAIL VALUE (ARV): One (1) prize package including a twelve (12) pack of 12-Inch Thick Odor-Free Bully Sticks, one (1) bag of Trachea Chips, 1lb, and one (1) $50 gift card to bestbullysticks.com. Total maximum ARV of Prize is $150.00.
   
   
   
7. PRIZE RESTRICTIONS:In the event that the Winner is unable (for any reason) or chooses not to accept the prize, the Sponsor reserves the right not to award the entire prize. Sponsor reserves the right to substitute a prize of comparable or greater value due to unavailability. No substitution or transfer of prize by winner is permitted. Gift card is subject to terms and conditions. Winner to be responsible for all applicable taxes (not limited to federal, state, local and/or income) on all aspects of their prize. Except where prohibited by law, acceptance of prize constitutes permission for Sponsor to use winner’s name, likeness, statements and other personally identifiable information for promotional, advertising and marketing purposes in any media throughout the world without additional prize, incentive, consideration, consent or review; and, upon request, winner will provide written consent to such use.
   
   
   
8. GRAND PRIZE WINNER DETERMINATION AND VERIFICATION: One (1) Potential prize winner will be chosen by vote by the community on @bestbullysticks Instagram. All entries that will be up for vote by the community will be valid entries only. WINNER IS SUBJECT TO VERIFICATION BY THE SPONSOR. AN ENTRANT IS NOT THE WINNER OF THE PRIZE UNLESS AND UNTIL ENTRANT HAS BEEN NOTIFIED THAT THE ELIGIBILITY VERIFICATION IS COMPLETE. Potential winner may be subject to a background investigation at Sponsor’s discretion. Sponsor reserves the right to disqualify potential prize winner on the basis of Sponsor’s review of the results of the background check.
   
   
   
9. NOTIFICATION OF WINNERS:The Sponsor will attempt to notify Prize Winner via Instagram direct message. If after exercising reasonable efforts, Best Bully Sticks cannot reach an entrant within two weeks from the first attempt to contact them, best Bully Sticks will be free of any liability for awarding a given prize to that entrant and such prize may be considered by the Sponsor to be forfeited for all purposes. If there is a dispute as to the identity of an entrant, the prize will be awarded to the authorized account holder of the social media account submitted when the entry was posted.
   
   

13. GENERAL CONDITIONS/RELEASE: By participating, Entrants (a) release Promotion Entities, their respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use or misuse of the prize; (b) if prize winner (except where prohibited by law) consents to the use by Sponsor of his/her name, hometown, likeness, statements and other personally identifiable information for promotion, advertising and marketing purposes in any media throughout the world without additional consideration and consent or prior review, and upon request will provide written consent to such use; and (c) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, the prize quality or availability except for Sponsor and the limited warranty provided with the prize vehicle.
    
    
    
14. GOVERNING LAW/JURISDICTION/DISPUTE RESOLUTION:Entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the state of Virginia; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (c) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the State of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Virginia.
